In 2016, LAPD SWAT officer Gabriel Gaxiola was arrested for driving under the influence while operating a department-issued SWAT vehicle.
He refused to submit to alcohol testing at the scene, but a later chemical test showed his blood alcohol level was 0.202, more than twice the legal limit. Officers also found an open bottle of beer inside the SWAT vehicle.
In 2022, Gaxiola was arrested again after he crashed his car while driving drunk. He refused to submit to alcohol testing, forcing officers to get a search warrant for a blood draw.
The test — taken five hours after the crash — showed a blood alcohol level of 0.155. Investigators estimated his BAC was around 0.23 at the time of the crash.
