Two men were standing in a parking lot outside a gym having a conversation when LAPD Wilshire officers arrived and began harassing them.
Officer Jamar Butler, who initiated the confrontation, antagonized one of the men by calling him “Little Man” and deliberately shining his flashlight at the man. The officers claimed the men were “loitering,” but loitering is only a crime if someone is lingering without lawful purpose and with the intent to commit a crime.
Two men talking before entering a gym clearly does not meet this criterion. The complaints were sustained.
