Bernardo Toro Miramontes

Officer Toro Miramontes along with his partner Brandon Prisk targeted a man for an unlawful pretextual stop, violated his constitutional rights. Toro Miramontes not only failed to provide a business card (as required) but took it a step further and gave an incorrect serial number in an attempt to avoid being identified. Misconduct included: 

• Conducted an unlawful pretextual stop
• Failed to articulate a legal basis for the detention
• Performed an unlawful Terry search
• Provided false identification (incorrect serial number: “404-4000” vs. actual “44517”)
• Refused to provide a business card upon request
• Failed to facilitate or initiate a complaint when the individual appeared to request one
